Upcoming PPA Webinar: Overview of FTC Non-Compete & DOL Overtime Eligibility Rule

There are two new federal laws that will have an impact on the business community (including petroleum marketers). The PPA is hosting a webinar on July 25 at 9:00 AM with member HMS Legal to provide an overview of the two regulations to ensure you are prepared to comply.

The U.S. Department of Labor (DOL) overtime eligibility rule went into effect on July 1. Currently, salaried workers making less than $35,568 annually qualify for overtime pay when they work more than 40 hours in a week.  Starting today, the threshold will increase from $35,568 to $43,888 per year.  It will then increase again to $58,656 on January 1, 2025.

Federal Trade Commission (FTC) non-compete ban will go into effect on September 4. This proposed rule will effectively bans all non-compete agreements between employers and “workers” as “unfair method(s) of competition” and requires employers to refrain from enforcing most existing non-compete agreements.

Legal challenges for both regulations are still pending which will be reviewed as a part of the July 25 webinar presentation. The webinar will also cover:

  • Who is impacted and who isn’t
  • What companies need to be aware of in order to comply
  • How companies can protect proprietary information (for FTC rule)
  • How to revise companies policies in order to be compliant
