Pennsylvania Attorney General Publishes ENDS Directory List


The Pennsylvania Office of Attorney General has announced the Electronic Nicotine Delivery Systems (ENDS) Directory List is now publicly available at:

The publication of the directory fulfills the requirements of Act 57 of 2025, which established a state-maintained directory of approved nicotine vapor products and manufacturers authorized for sale in the Commonwealth of Pennsylvania.

Under Act 57, every manufacturer of nicotine-containing electronic cigarettes sold at retail in Pennsylvania must be certified by the Attorney General. Manufacturers seeking inclusion on the directory were required to submit certification forms by April 21, 2026, and must continue to submit annual certifications by April 21 of each subsequent year to remain listed.

The law became effective on February 20, 2026, and directs the Attorney General to maintain and publicly publish a directory identifying approved manufacturers and products, including brand names, product categories, product names, and flavors. The directory may include products that have received an FDA Marketing Granted Order (MGO) as well as certain products with Premarket Tobacco Product Applications (PMTAs) that meet the statutory requirements.

The Attorney General is required to update the directory at least monthly to ensure accuracy. Retailers, wholesalers, importers, manufacturers, and other industry participants are encouraged to regularly review the directory and monitor updates.

Beginning October 18, 2026, any nicotine-containing ENDS product not appearing on the directory will be subject to seizure by the Commonwealth. In addition, retailers, wholesalers, and importers who sell or offer for sale products not listed on the directory may face significant civil penalties, license suspensions, license revocations, and responsibility for seizure, storage, transportation, and destruction costs.

Industry members are encouraged to verify that all ENDS products offered for sale in Pennsylvania appear on the published directory and to monitor future updates from the Office of Attorney General.
