The Pennsylvania Petroleum Association and Pennsylvania Propane Gas Association will be hosting an emergency planning exercise on October 11, 2023. The exercise will be facilitated by our state agency partners for the purpose of strengthening the Pennsylvania State Energy Security Plan (SESP). Other stakeholders who rely on the interdependency of liquid fuels throughout the Commonwealth will also participate in the exercise.

It’s the festive holiday season and bitter cold has lingered in Pennsylvania and the Northeastern United States for the past several days. Dropping temperatures are predicted over the holiday while the electric grid operator is projecting record breaking usage. How will fuel companies provide for their customers as temperatures continue to drop? Join us as we delve into this scenario and try to prevent a Christmas Lights Out.

Participating associations would like to ensure all segments of the fuel industry are represented as a part of the exercise. Proposed representation would include: Heating Fuel & Propane Marketers, Motor Fuel Distributors, Retail Gasoline Stations, Common Carriers, Fuel Wholesalers, Terminal Operators, Pipeline Operators, Refiners/Producers, Alternative Fuel Stakeholders

All participants will be asked to complete a Nondisclosure Certification for the exercise. This standard operating document will protect information shared by both public sector and private sector participants.

NONDISCLOSURE CERTIFICATION

I, acting in my individual capacity and as an authorized agent or employee of my organization, hereby make the following representations subject to the provisions and penalties of 18 Pa.C.S. § 4904 pertaining to unsworn falsification to authorities as a condition of my participation in the October 11, 2023 exercise and facilitated discussion hosted by the Commonwealth of Pennsylvania, Department of Environmental Protection (DEP) for state agencies and fuel industry stakeholders concerning a hypothetical prolonged energy emergency scenario due to a fuel shortage (“Fuel Shortage Exercise”):

  1. Participation in the Fuel Shortage Exercise includes representatives from the public and private sector. Discussions during the Fuel Shortage Exercise may include the disclosure or discussion of Sensitive Information.
  2. As a participant in the Fuel Shortage Exercise and representative of my organization, I represent that I shall not tell, relay, duplicate, record, or in any other way, divulge Sensitive Information disclosed to me during my participation in the Fuel Shortage Exercise to any person and/or organization that did not participate in the Fuel Shortage Exercise. Sensitive Information includes, but is not limited to, the following:
    1. Confidential security information as defined by Section 2 of the Act of Nov. 29, 2006, P.L. 1435, No. 156, as amended, 35 P.S. § 2141.2;
    2. Confidential proprietary information or specific business or management practices identified by the participants of the Fuel Shortage Exercise;
    3. Locational information concerning infrastructure that could reasonably be considered potential targets for threats against human health and safety; and
    4. Descriptions of “on-hand” fuel volumes.
    5. Law Enforcement Sensitive information that could adversely affect ongoing investigations, create safety hazards for officers, divulge sources of information, and/or compromise their identities.
    Sensitive Information does not include information that is currently publicly available.
  3. I shall take all reasonable steps, at least as great as the steps taken with respect to confidential or proprietary information by my own organization, to protect Sensitive Information disclosed to me during my participation in the Fuel Shortage Exercise.
  4. I shall not use or disclose Sensitive Information provided to me during my participation in the Fuel Shortage Exercise for my organization’s benefit, or for the personal or commercial benefit of myself or any other person or entity.
  5. I shall immediately notify DEP in writing of any loss, theft, misuse, misappropriation, unauthorized disclosure or other security violation of Sensitive Information that I have knowledge of, whether or not I am personally involved.
  6. I acknowledge that this representation does not supersede any court order or law, including the Pennsylvania Right-To-Know Law.
  7. I understand that any participant in the Fuel Shortage Exercise may rely on the representations made herein.
  8. Each provision of this representation is severable.
  9. I recognize that the improper dissemination of Sensitive Information may expose me and my organization to legal liability to the extent permitted by law and as determined by a court of competent jurisdiction.
  10. No provision herein may be construed to be a waiver of sovereign immunity of DEP and/or the Commonwealth of Pennsylvania.
  11. I recognize that my obligations under this certification are of a continuing nature.

I hereby acknowledge that I have read and understand the above representations and that I agree to abide by each representation as an individual and on behalf of my organization as its authorized agent. I understand that by signing this document I make these representations subject to the provisions and penalties of 18 Pa.C.S. § 4904 pertaining to unsworn falsification to authorities.
